Terms and Conditions – Dallas Aquarium Kings

Effective Date: 05/03/2026

This Agreement governs all purchases, deliveries, installations, livestock, and services provided by Exotic Animal Exchange LLC dba Dallas Aquarium Kings (“Company”). By purchasing, Customer agrees to all terms below.

1. ALL SALES FINAL

All purchases are FINAL, NON-REFUNDABLE, AND NON-CANCELLABLE.

  • No cancellations after order is placed
  • No returns accepted
  • No refunds for any reason
  • Customer agrees not to initiate chargebacks

2. DELIVERY & INSTALLATION

  • Installation typically occurs within 2–3 business days
  • Customer must provide safe and accessible installation area
  • Delays caused by Customer do not qualify for refunds

3. PRODUCT VARIATION DISCLAIMER (VERY IMPORTANT)

Aquascaping / Appearance

Customer acknowledges:

  • The aquarium will NOT look exactly like photos or examples shown
  • Aquascaping varies based on:
    • Available materials
    • Natural variation in driftwood and rock
    • Artistic discretion of installer

Company guarantees a high-quality, professionally designed layout, but not an exact replica.

Stand Color Guarantee

  • The stand color selected by Customer WILL be honored

Livestock (Fish) Disclaimer

Customer acknowledges:

  • Company does NOT guarantee specific fish species, colors, or sizes
  • Company guarantees:
    • The number of fish purchased only
  • Fish selection is based on:
    • Availability
    • Health and compatibility
    • Professional judgment

4. CUSTOMER RESPONSIBILITY

At installation, Company will explain:

  • Equipment operation
  • Basic maintenance
  • Livestock care

Customer assumes full responsibility after installation.

5. ASSUMPTION OF RISK

Aquariums involve inherent risks including:

  • Water damage / leaks
  • Structural load stress
  • Electrical hazards
  • Livestock loss

Customer accepts all risks.

6. NO LIABILITY FOR PROPERTY DAMAGE

Company is NOT LIABLE for any damage, including but not limited to:

  • Floors (wood, tile, carpet)
  • Walls, cabinetry, or structures
  • Structural damage from weight
  • Electrical issues
  • Water leaks, flooding, humidity

7. NO LIABILITY FOR PERSONAL INJURY

Company is not responsible for:

  • Injury or death
  • Tipping hazards
  • Slips, falls, electrical exposure
  • Injury to children, pets, or guests

8. TIPPING & SAFETY WARNING

Aquariums are extremely heavy and can tip.

Customer agrees to:

  • Keep children and pets supervised
  • Not allow climbing or leaning
  • Maintain a safe environment

9. LIVESTOCK WARRANTY

With Service Plan

  • Fish covered for 30 days
  • Replacement at Company discretion

Without Service Plan

  • Fish covered for 72 hours only
  • Customer must pick up replacements

No coverage for:

  • Water quality issues
  • Improper care
  • Equipment misuse

10. EQUIPMENT WARRANTIES

  • All warranties are provided by manufacturers only
  • Manufacturer has sole authority over claims
  • Company does NOT guarantee outcomes

If Customer has a service plan:

  • Company will assist with claims within reason

11. NO COMPANY WARRANTIES

All products/services are provided AS IS
No guarantees on:

  • Performance
  • Longevity
  • Livestock survival beyond stated terms

12. INDEMNIFICATION

Customer agrees to fully indemnify and hold harmless the Company from all claims including:

  • Property damage
  • Personal injury
  • Livestock-related issues
  • Third-party claims

13. LIMITATION OF LIABILITY

Company liability is limited to:

👉 Amount paid for the product

Company is NOT liable for:

  • Indirect or consequential damages

14. HIDDEN CONDITIONS DISCLAIMER (IMPORTANT ADD)

Company is not responsible for:

  • Hidden plumbing, wiring, or sprinkler lines
  • Subfloor or structural issues
  • Pre-existing damage

15. PAYMENT ENFORCEMENT

Customer agrees to pay:

  • All collection costs
  • Attorney fees
  • Legal expenses

16. ARBITRATION

All disputes resolved via:

👉 AAA Arbitration (Dallas, TX)
👉 No jury trial
👉 Prevailing party gets attorney fees

17. MEDIA RIGHTS

Company may:

  • Photograph and film installation
  • Use content for marketing

18. GOVERNING LAW

Texas law applies.

19. ACCEPTANCE

By purchasing, Customer:

  • Confirms they read and agree
  • Accepts all risks
  • Waives liability
